An English-speaking canon from Shaftestbury did not hesitate to publish "a canonical, theological and pastoral defense against the envisaged excommunication of the Priestly Society of Saint Pius X".
According to kath.net of April 29, 2026, the Vatican will declare the Society of Saint Pius X excommunicated and schismatic after the episcopal consecrations scheduled for July 1 in Écône, Switzerland. The German-language website reports the words of Italian journalist Nico Spuntoni to American Vatican expert Diane Montagna: "Well-informed sources have confirmed to me that the Dicastery for the Doctrine of the Faith is already preparing for a schism after the new episcopal consecrations." And according to the same sources, Nico Spuntoni asserts that the dicastery of Cardinal Víctor Manuel Fernández is considering providing "pastoral support to members of the clergy belonging to the Society who do not wish to remain, after another break with Rome."
Regarding this potential excommunication, it is helpful to refer to the opinion of Fr. Jaime Mercant Simó, a Spanish canonist, who declared on February 21st that there would be "neither schism nor sin" as a result of the consecrations at Écône. Along the same lines, the American website Rorate Caeli published, on May 6th, the judgment of a canon from Shaftesbury, who understandably wishes to remain anonymous in these turbulent times. This English-speaking canonist did not hesitate to publish "a canonical, theological, and pastoral defense against the proposed excommunication of the Society of Saint Pius X."
According to him, an excommunication, "if imposed, would be neither canonically sensible, nor theologically consistent, nor pastorally opportune. Based on the Church's legal tradition, historical precedents, and the pastoral imperatives constantly invoked by recent pontificates, it can be argued that the envisaged excommunication would be arbitrary, inconsistent, and counterproductive to the unity and mission of the Catholic Church."
And to point out: “For years, the Society has been seeking a negotiated regularization and solution to the question of episcopal succession. The Vatican’s apparent inability to meet with the Society, while extending its welcome to doctrinally far more heterodox groups, reveals a troubling double standard that undermines the credibility of Rome’s disciplinary authority and sends a harmful message to the faithful attached to Church tradition.”
The canon lawyer points out that this proposed excommunication would represent a triple failure, because:
"1. Canonically, the state of necessity, the absence of schismatic intent and the strict interpretation of the law argue against the sanction.
Lionel : The issue is Vatican Council II irrationel winch Pope Leo accepts and whose conclusion is rejected by the SSPX. The SSPX also rejects the ‘reforms ‘of Vatican Council II interpreted irrationally.
We now know that the Council can be interpreted rationally or irrationally and the conclusion will be traditional or schismatic. Pope Leo interprets the Council irrationally and accepts the non traditional, liberal and schismatic conclusion.
The SSPX also interprets Vatican Council II irrationally but rejects the liberal conclusion. Both the SSPX and Pope Leo do not interpret Vatican Council II rationally and so in harmony with Tradition.
Cardinal Gerhardt Muller has appealed to the SSPX to accept Vatican Council II, irrational as he does and then the ordinations will not be an issue. In China the ordination of bishops is allowed, since the Chinese priests accept Vatican Council II irrational and schismatic.

"2. Theologically, the difference in treatment between Catholics faithful to doctrine and heterodox Catholics reveals an ecclesiological inconsistency.
Lionel : Yes and this canonist has not dealt with this issue. We can interpret Vatican Council II with LG 16 visible or invisible and the conclusion will be different the ecclesiology will be different.

“3. From a pastoral perspective, the sanction would abandon vibrant communities to unjust marginalization, when peaceful solutions exist.”
And to plead for a peaceful solution: “The Society of Saint Pius X has been saying for years that the Church is going through a crisis of faith, of liturgy, and of its very identity.
Lionel : True but the SSPX like Pope Leo interprets Vatican Council II, the Nicene Creed and all the Catechisms irrationally and not rationally contributing to the doctrinal and theological crisis which has a spill-over in the liturgy.
The Holy See’s response to the planned consecrations risks confirming this diagnosis: when those who defend tradition are treated as enemies, and those who contradict it are considered partners, it means that disorder has taken hold.
Lionel : The issue is still Vatican Council II irrational and rational which Fr. Davide Pagliarani has not addressed in his Declaration of Faith. It does not mention Vatican Council II, either-way.
Based upon Vatican Council II irrational Archbishop Carlo Maria Vigano was officially, declared to be in schism. With Vatican Council II rational, it is Cardinal Fernandez who would be in schism.
1.He does not affirm the Nicene Creed in the original based upon LG 16 etc interpreted as being invisible cases.
2.He does not interpret the Athanasius Creed with no exceptions mentioned in Vatican Council II.
3.He does not affirm the dogma extra ecclesiam nulla salus of the Council of Florence 1442 with no exceptions mentioned in Vatican Council II.
4.He does not affirm the Catechism of the Catholic Church 845-846 , with CCC 847-848 not being explicit exceptions in 1965-2026.
This is first class heresy according to Ad Tuendem Fidem of Pope John Paul II. There has been no denial from the Vatican.
It is the liberal cardinals who are in heresy on the the Nicene Creed. It is they who are in schism.

The remedy is not the hammer of the law, but the outstretched hand of dialogue, mercy, and a truly pastoral application of canon law, which the Church retains for the good of all its faithful.”
Lionel : The traditionalist media and websites are not affirming Vatican Council II rational in harmony with the strict interpretation of the dogma extra ecclesiam nulla salus. They want to maintain a Vatican Council II irrational which is politically correct.So then can maintain their comfortable and secure status. They will not be de platformed etc. The SSPX has been doing the same.
